TERMS OF SERVICE

These Terms of Service govern your use of the MIQU website and any purchase made through it.
By accessing this website, creating an account or placing an order, you agree to these Terms together with our Privacy Policy, Returns & Refunds Policy and Delivery information.
MIQU is operated by MAISON MIQU registered at the United Arab Emirates.
Nothing in these Terms limits any rights available to you under applicable consumer-protection law.

01 — THE WEBSITE
The MIQU website is provided for personal, lawful use and for the purchase and discovery of MIQU products and services.
You may not misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious technology, reproduce its contents unlawfully or use it for fraudulent or unlawful purposes.
MIQU may update, suspend or modify elements of the website where reasonably necessary.

02 — ORDERS
An order submitted through the website constitutes an offer to purchase the selected products.
Receipt of an order confirmation does not necessarily mean that the order has been accepted. An order is accepted when MIQU confirms acceptance or dispatches the relevant products, subject to applicable law.
All orders remain subject to product availability, payment authorization, delivery availability and our ability to fulfil the order.
If MIQU cannot accept or fulfil an order, MIQU Client Care will notify you and any amount already collected for the unavailable item will be refunded as appropriate.
MIQU reserves the right to decline or cancel an order where there is reasonable evidence of fraud, unauthorized payment activity, misuse of the website, an obvious pricing or product-information error, or another legitimate reason permitted by law.

03 — PRODUCT INFORMATION
MIQU takes care to present product descriptions, imagery, sizes, ingredients, directions and other information accurately.
Screen settings, photography and production variations may result in minor differences in the appearance of a product or its packaging.
Packaging, ingredients or presentation may be updated where necessary, provided that such changes do not misrepresent the product or materially diminish what has been purchased.
Please review the product information and directions supplied with each formula before use.

04 — SKINCARE & PRODUCT USE
MIQU skincare products are cosmetic products unless expressly stated otherwise. Information provided on the website is intended to describe the products and their intended cosmetic use and is not medical advice.
Individual experiences may vary according to skin, environment, application and other factors.
If you have concerns regarding a medical condition, allergy, sensitivity, pregnancy, medication or suitability of a product for your circumstances, seek appropriate professional advice before use.
Nothing in this section excludes responsibility that MIQU cannot lawfully exclude.

05 — PRICES
Product prices are displayed in the currency selected or indicated on the website.
The price applicable to your purchase is the price shown when your order is submitted, subject to correction of an obvious error in accordance with applicable law.
MIQU may revise prices for future purchases without affecting an order that has already been accepted at a confirmed price.
Any applicable taxes, delivery charges, duties or other charges will be presented or explained where required before purchase or in the relevant delivery information.
MIQU does not engage in artificial reference pricing or misleading promotional pricing.

06 — PAYMENT
Payment must be made using one of the payment methods available at checkout.
Payments may be processed by authorized third-party payment providers. By submitting payment information, you confirm that you are authorized to use the selected payment method.
Orders may be subject to payment verification and fraud-prevention procedures designed to protect both clients and MIQU.
MIQU does not guarantee that every payment method will be available in every market.

07 — DELIVERY
Available delivery destinations, estimated delivery periods and any applicable charges are shown through the website or described in our Delivery information.
Delivery estimates are provided in good faith but may be affected by customs procedures, carrier operations, public holidays, weather, events outside MIQU's reasonable control or other circumstances.
MIQU will remain responsible for its obligations to clients to the extent required under applicable law.
Please ensure that delivery information supplied at checkout is complete and accurate.

08 — RETURNS & REFUNDS
Returns, refunds, damaged products and incorrect orders are governed by the MIQU Returns & Refunds Policy.
Nothing in that policy or these Terms restricts any mandatory rights or remedies available under applicable consumer-protection law.

09 — CANCELLATIONS & ORDER CHANGES
If you wish to amend or cancel an order, contact MIQU Client Care as soon as possible.
We will make reasonable efforts to assist. Once an order has entered preparation or dispatch, it may no longer be possible to alter or cancel it.
Any applicable return rights remain governed by the Returns & Refunds Policy and applicable law.

10 — INTELLECTUAL PROPERTY
The MIQU name, wordmarks, symbols, designs, product names, packaging, imagery, photographs, films, text, graphics, website design and other creative or proprietary material appearing on the website belong to MIQU or are used under appropriate license.
They may not be copied, reproduced, modified, distributed, commercially exploited or used to create derivative works without prior written authorization, except where such use is expressly permitted by law.
No use of the website grants any license or right to MIQU intellectual property except the limited right necessary to access and use the website for its intended purpose.

11 — THIRD-PARTY SERVICES
The website may rely on or link to services operated by third parties, including payment, delivery or technology providers.
Where you interact directly with an independent third-party service, its own terms or policies may also apply.
MIQU is not responsible for independent third-party services to the extent permitted by applicable law, but this does not limit MIQU's responsibilities to you as the seller of MIQU products.

12 — PRIVACY
Personal information is handled in accordance with the MIQU Privacy & Data Protection Policy and applicable law.
Please review that policy for information concerning how personal information is collected, used, disclosed and protected.

13 — LIABILITY
MIQU does not seek to exclude or restrict liability where doing so would be unlawful.
To the fullest extent permitted by applicable law, MIQU will not be responsible for losses that were not reasonably foreseeable, losses caused by circumstances outside our reasonable control, or business losses arising from a purchase made primarily for personal consumer use.
Nothing in these Terms excludes or restricts liability for fraud, willful misconduct or any other responsibility that cannot legally be excluded or restricted.
Your statutory consumer rights remain unaffected.

14 — EVENTS OUTSIDE OUR CONTROL
MIQU will not be responsible for delay or failure caused by circumstances genuinely outside its reasonable control, including significant carrier disruption, natural events, government action, infrastructure failure or similar events.
Where such circumstances affect an order, MIQU will take reasonable steps to communicate with affected clients and fulfil its obligations in accordance with applicable law.

15 — CHANGES TO THESE TERMS
MIQU may update these Terms when its services, operations, legal obligations or website change.
The revised Terms will apply from the date stated at the beginning of the document and will not retrospectively alter an order already concluded except where required by law.

16 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

17 — GOVERNING LAW
These Terms are governed by the laws of the United Arab Emirates, subject to any mandatory protections or rights available to consumers under the law applicable to them.
Any dispute will be submitted to the courts having competent jurisdiction, except where applicable law provides the client with another mandatory right or forum.
